NIL and Taxes

Most NIL checks come with no tax taken out. You get the whole amount, and the IRS expects its share later. This lesson shows when you owe, why free gear counts, and how much of each deal to set aside, using the 2026 IRS rules. Then you make the calls in the Film Room.

Is NIL money taxable?

Yes. All NIL income is taxable, including free products and gift cards, whether or not anyone sends you a tax form. If a brand pays you to post, show up or sign autographs and you are not their employee, the IRS treats that pay as self-employment income, which carries its own extra tax.

There are two exceptions. If a company puts you on payroll and gives you a W-2, you are an employee and tax comes out of your pay. If a company only pays to use your picture or name and you do no work at all, that is a royalty, which is taxed differently. This lesson covers the first kind: you do something, you get paid.

Whose income is it if the brand pays my parent?

Yours. Money you earn for NIL work is your income for taxes, not your parent's, even if the brand sends the payment to a parent. Before a brand pays you, it will usually ask for a Form W-9 with your Social Security number. Fill it out correctly. If you don't, a brand that pays you $2,000 or more in the year may have to hold back 24% of your pay and send it to the IRS. That money counts toward your tax when you file. Only give your Social Security number to a company you have checked is real (Module 02 shows the warning signs).

Will I get a 1099, and does it matter?

A business only has to send you a Form 1099-NEC once it pays you $2,000 or more in a year, starting with payments made in 2026. It used to be $600. But the form is only the business's paperwork. A $900 deal with no form is still income you report.

If you get paid through a payment app, you may never see a 1099 at all. Apps only have to send a Form 1099-K once you pass $20,000 and 200 payments in a year. You still owe the tax either way.

Does free gear count as income?

Yes. Free shoes, clothes, products, gift cards or services you get for NIL work count at what they would normally sell for. So $500 of free shoes counts the same as $500 in cash, including for self-employment tax. Write down what you got, when, and what it was worth.

What is self-employment tax?

It is Social Security and Medicare tax for people who work for themselves: 15.3% in total. You pay it on 92.35% of your profit, which works out to about 14.1% of what you keep after business costs. It starts once your NIL profit for the year reaches about $434.

An employee pays half of this tax and the employer pays the other half. When you work for yourself, you pay both halves. You do get to subtract half of it when you figure your income tax.

Do I have to file a tax return if my parents claim me?

Yes, once your NIL profit for the year reaches about $434, even if a parent claims you as a dependent. That is the point where net earnings from self-employment hit $400, and the IRS says anyone at that level must file their own federal return.

Your 2026 return is due April 15, 2027. If you live in New York and have to file a federal return, you have to file a New York return too, and New York City residents also owe city tax.

A dependent's standard deduction in 2026 is the bigger of $1,350 or earned income plus $450, up to $16,100. If NIL pay for work is your only income and your profit is under about $17,300, federal income tax is $0 and the only federal tax is self-employment tax.

How much should I set aside?

Below about $17,300 of profit, about 14.1% of NIL profit covers federal tax, and it is all self-employment tax. State tax comes on top, so set aside a little more. These figures assume a parent claims you and you have no business costs, and they come from the same math as our NIL Tax Calculator.

Notice the gear row: $500 of free shoes adds tax even though it is not cash, so you pay it out of your cash. New York taxes this income too, and so may any other state where you do NIL work. Check your state's rules. Want your own numbers? Use the NIL Tax Calculator.

Do I have to pay taxes during the year?

Only if you expect to owe $1,000 or more when you file. Self-employment tax counts toward that. If you owed no tax for all of last year, there is no penalty for waiting until you file. You are also safe if you pay at least 90% of this year's tax or 100% of last year's, split across the four due dates.

The 2026 due dates are April 15, June 15 and September 15, 2026, and January 15, 2027. On the table above, only the $10,000 year crosses $1,000. A player who owed nothing for 2025 has no penalty for 2026, but should have the money ready by April. Everyone else pays in pieces: the IRS checks each due date, so paying it all in January can still bring a penalty for the earlier dates. If most of your NIL money came late in the year, a tax professional can use the IRS's uneven-income method (on Form 2210) to shrink or remove that penalty.

Can I lower what I owe?

Yes. Normal, needed costs of your NIL work lower the profit you pay tax on, like travel to an appearance, if you keep a log. The catch is proof. Keep receipts and a simple log of every payment, every piece of free gear and every cost, and keep them as long as you might need to back up your return.
